available. Note that all of these opinions are published. However, unpublished opinions are also
indexed in the case law database. The inclusion of unpublished
opinions is significant, particularly in light of a recent opinion
issued by the United States Court of Appeals for the Eighth
Circuit. The Court found in Anastasoff
v. United States, No. 99-3917, 2000 WL 1182813, at *6;
2000.C08.004298 (8th Cir. Aug. 22, 2000) that the portion of 8th
Circuit Rule 28A(i) that states unpublished opinions are not
precedent is unconstitutional under Article III of the United
States Constitution. Unpublished opinions are also helpful in
terms of providing guidance and insight into how a Court may be
inclined to rule in a particular instance.
